Joe Biden and his gang of bureaucrats hated that the U.S. Supreme Court overturned their sacred cow, Roe v. Wade (1973). But the court in 2022 tossed that unconstitutional “law of the land” into the trash heap where it belongs.
The Biden administration tried to shore up “abortion rights” every chance it got.
For example, the U.S. Department of Health and Human Services under Biden illegally expanded the Emergency Medical Treatment and Labor Act to include abortion as stabilizing care in ERs. Congress did not intend this at all in 1986.
The FDA under Biden changed the rules to allow women seeking abortions to do telemedicine appointments instead of in-person to get prescriptions for abortion drugs, and to receive these drugs through the mail.
Biden’s bureaucrats illegally redefined and expanded the definition of words in federal law to ensure that those who oppose abortion would be forced to accommodate it and/or pay for it.
Most relevant to the topic of this post, the U.S. Department of Veterans Affairs (VA) in 2022 implemented a rule to provide abortion counseling and abortions for pregnant veterans and beneficiaries if the woman’s life or health is in danger or in cases of rape or incest. A Christian nurse requested a religious accommodation.
The VA said no but supposedly added a religious accommodations process to the new rule after the nurse sued. She received her accommodation.
The new process didn’t stop the VA from discriminating against other Christian employees. According to the American Center for Law and Justice (ACLJ), an ER doctor who worked at the VA shared the nurse’s view on abortion and filed a conscientious objection waiver, along with the entire ER staff. VA bureaucrats did not like this. The doctor resigned in 2023. From ACLJ:
In December 2025, a position opened at that same VA. Dr. Mohr applied and received an offer of employment. However, the same leadership that had threatened him in 2023 personally rescinded his offer in March – just weeks before he was supposed to start work – with no explanation.
ACLJ filed a complaint with the U.S. Equal Employment Opportunity Commission on the doctor’s behalf, alleging that the VA violated his religious and moral rights.
The Trump administration likely will agree to investigate the allegations and order the bureaucrats to respect the rights of religious employees.
