The Trump administration has officially wiped the Biden administration’s Title IX rewrite from the federal regulations. And good riddance.
The U.S. Department of Education (ED) announced Monday that it formally rescinded the 2024 Title IX rule and restored the regulations adopted during President Donald Trump’s first term.
The Biden administration continued what the Obama administration started: changing the definition of the word “sex” in civil rights law to include sexual orientation and “gender identity.”
Title IX prohibits sex discrimination in schools and colleges that receive federal funding. Congress did not intend anti-discrimination law to apply to men pretending to be women.
President Trump began enforcing the 2020 regulations shortly after he returned to office. After years of litigation against the expanded definition, ED issued Monday’s final regulation restoring the previous regulatory text.
Linda McMahon, ED secretary, said the change will reduce confusion for parents, students, and schools.
“We will continue to relentlessly champion equal opportunity for all Americans and hold accountable any school or college that violates the rights, privacy, or athletic opportunities of our women and girls,” McMahon added.
ED says it will continue enforcing Title IX based on biological sex, including protections involving women’s sports, bathrooms, locker rooms, and other sex-separated facilities.
