Fairfax County School District BACKS DOWN on Forcing Girl to Lie About Pronouns and Share Restrooms with Boys — DAMAGES

America First Legal (AFL) announced good news this week for a high school girl who does not want to lie about pronouns or share a restroom or locker room with a boy.

According to the school district’s “transgender” policy, a boy who pretends to be a girl is allowed to violate girls’ privacy and undermine their safety.

AFL filed a lawsuit on behalf of the girl, a Roman Catholic, against Fairfax County Public Schools (FCPS) in 2024. The school district attempted to make the case go away twice but failed. Now FCPS has decided to give up the fight. From AFL:

After repeatedly failing to get the case thrown out of court, the school board has now conceded, offering judgment, awarding nominal damages to AFL’s client, and paying costs and attorneys’ fees.

Since AFL filed the lawsuit against the school district, the U.S. Department of Education concluded in an investigation that FCPS was one of five Northern Virginia school districts that violated Title IX.

FCPS has not been successful in their efforts to continue violating girls’ privacy and undermining their safety.

“This case is part of a much larger struggle for basic fairness and safety,” said Ian Prior, senior counsel at AFL. “No student should face the threat of punishment or be pushed aside for asserting their fundamental constitutional rights.”

Jason Miyares, Virginia’s attorney general, submitted an amicus brief in the case — over the school board’s objections.
