Pro-Lifers Hope This Pro-Abortion Amendment Proposal in Virginia Will Fail — Even if It Passes

Abortion advocates, still enraged that the U.S. Supreme Court overturned Roe v. Wade, will keep pushing the death of the unborn.

Charla Bansley, a Bedford County supervisor in Virginia, filed a lawsuit to stop a ballot measure that would add a so-called abortion rights amendment to the state constitution.

Bansley argues that Virginia lawmakers didn’t follow the proper procedure. They skipped the required steps meant to give the public notice of the proposed amendment.

Liberty Counsel (LC) represents Bansley. She said that lawmakers failed to send the amendment to circuit court clerks statewide and post it for public inspection before the 2025 House of Delegates election.

The amendment will remain on the ballot but could still be invalidated even if it passes.

A lower court dismissed Bansley’s case, saying she had no legal standing to sue and that lawmakers had fixed the problem by repealing the requirements afterward.

Pro-lifers should watch this case closely. Mat Staver, LC founder and chairman, said that the Virginia Supreme Court earlier this year invalidated a redistricting referendum over similar procedural failures.

“This case will likely go to the Virginia Supreme Court after appellate review is completed,” he said. “Voters deserve certainty on a state constitutional amendment before an election, not after.”
