Race-Neutral Government v. Discrimination

Jennifer Gratz, a victor in the U.S. Supreme Court case Gratz v. Bollinger, which ruled the University of Michigan’s points-for-race admissions scheme unconstitutional, discusses the court’s recent decision about Michigan’s ban on racial preferences with race-neutral government opponent Shanta Driver. Gratz confirmed that Michigan assessed preferred minority applicants (typically black, Hispanic, and American Indian) on a different (lower) standard than white and Asian applicants.
