Days after losing at the U.S. Supreme Court, Rob Bonta, California’s attorney general, is still trying to violate parents’ and teachers’ rights.
Two Christian middle school teachers, Elizabeth Mirabelli and Lori Ann West, along with parents and other teachers, filed a lawsuit after the women were put on administrative leave for refusing to lie to parents and keep secrets from them about children’s “gender” confusion.
The Supreme Court issued an emergency ruling on March 2 in the Mirabelli v. Bonta case, concluding that the parents likely would succeed on their claims.
A federal district court had ordered California officials to publicly state that parents have a constitutional right to be informed if their child expresses “gender confusion.” Although the U.S. Court of Appeals for the Ninth Circuit blocked that order while the case is still pending, the Supreme Court lifted the block on the parents’ claims, which meant the district court’s order to post the statement was back in effect.
The Supreme Court did not lift the block on the teachers’ claims.
Laura Powell, an attorney at the Thomas More Society, announced that Bonta, a defendant in Mirabelli, has asked the Ninth Circuit to block or rewrite the district court’s statement, claiming that it does not “track the reasoning in the Supreme Court’s decision.”
“While it may make sense to clarify precisely which parts of the stay remain in place,” Powell wrote on X, “it’s outrageous to suggest that the SCOTUS order doesn’t have to be strictly followed because the per curiam opinion issued as part of the emergency docket doesn’t perfectly explain its reasoning. The Court was aware of the content of the statement when it ordered the stay lifted (emphasis added).”
Powell added that it “must be frustrating for the lawyers representing the plaintiffs to have to relitigate these issues after such a decisive win in the Supreme Court.”
