The U.S. Supreme Court on Tuesday ruled to protect the privacy, safety, and sports opportunities for women by upholding Idaho’s and West Virginia’s laws that bar boys and men from competing on girl’s and women’s sports teams.
The decision was unanimous.
The court said that states may require members of women’s sports teams to be women. Now other plaintiff states and individuals will cite this ruling in their own lawsuits.
Alliance Defending Freedom (ADF), which represents women who’ve filed lawsuits to stop enforcement of laws that allow men to join female sports teams, steal their victories, and put them in physical danger.
This all started during when the Obama administration illegally redefined “sex” in federal law to include sexual orientation and “gender identity.” Congress must amend laws, not the executive branch.
Unfortunately, the “conservative” Supreme Court ruled in Bostock v. Clayton County (2020) that an employer cannot discriminate based on “gender identity. A Christian funeral home owner fired his funeral director after he decided to make a spectacle of himself at work by pretending to be a woman.
Justice Neil Gorsuch wrote the majority opinion.
The irony is that Bostock was a factor in today’s decision. The Biden administration continued to cite Bostock‘s ruling to justify violating women’s civil rights.
“This is a victory for every girl who refused to stay quiet in the face of injustice,” said Kristen Waggoner, ADF CEO, president, and chief counsel. “Men cannot be women, and no drug erases the male athletic advantage…. Policies that ignore biological truth hurt people. In West Virginia, the male plaintiff defeated more than 470 girls over 1,400 times, won the women’s state championship in shot put, and sexually harassed our client Adaleia Cross in the girls’ locker room. Adaleia’s story is not unique. After today’s decision, the 23 states still on the sidelines have run out of excuses. Protect women’s sports. Our girls have waited long enough.”
