Santa Fe’s School District Called a Boy’s Inappropriate Sexual Behavior Normal — A Girl’s Parents Called it a Civil Rights Violation

You may recall reading about what happened in a Santa Fe school. Parents withdrew their first-grade daughter after she complained about a boy who uses girls’ restrooms and locker rooms and displays inappropriate sexual behavior.

The boy publicly displayed and touched his genitals in front of students and teachers. The girl complained, but Santa Fe Public Schools (SFPS) dismissed the complaint, calling the first-grade boy’s behavior normal. The girl’s parents took her out of school.

According to the complaint, the boy also expressed “inappropriate affections towards female students such as unwelcomed physical touch…” If a boy this young is doing things like this, the school needs to report the behavior to the relevant government agency. Someone could be molesting him.

Liberty Counsel (LC), the parents’ legal counsel, wrote a letter to SFPS informing administrators that the boy’s behavior violates parental rights and Title IX. LC requested corrective actions to protect all children and to stop keeping secrets from parents. They also asked administrators to protect girls’ privacy and safety.

SFPS refused to change its policies. The parents have filed a complaint with the U.S. Department of Education’s (ED) Office of Civil Rights. From LC (emphasis added):

The complaint further alleges that not only did SFPS fail to take action under Title IX’s sexual harassment standards, it encourages or facilitates “gender-transition” measures while delaying parental notification, contrary to federal court decisions affirming parental authority over such matters.

School districts like SFPS protect some students based on feelings but not others based on actual physical danger. As LC noted in the complaint, schools attempt to normalize inappropriate sexual behavior.

It won’t work. One child is not allowed to wreak havoc on the rest of the students. And SFPS needs to report the boy’s behavior for his protection.

“The deliberate indifference by Santa Fe Public Schools toward sexual misconduct and the safety and wellbeing of female students violates Title IX and ignores morality and biological reality,” said Mat Staver, LC founder and chairman.

The Trump administration has initiated investigations into government schools that violate girls’ privacy and undermine their safety. For example, ED found that five school districts in Virginia violated Title IX by discriminating against individuals on the basis of sex.
