Jocelyn Boden, a former Bath & Body Works store manager, hired a man pretending to be a woman. For some reason she didn’t foresee a problem. A member of LDS, Boden apparently didn’t think she was expected to refer to the man as “she.” Big mistake.
The man accused her of “misgendering.” Bath & Body Works refused Boden’s requested religious accommodation and fired her instead.
First Liberty Institute, which represents Boden, asked the U.S. Equal Employment Opportunity Commission to investigate Bath & Body Works last July.
The result? According to First Liberty, Boden has reached a favorable settlement with Bath & Body Works. An excerpt:
The terms of the settlement were not made public.
“Employers cannot force you to personally affirm a radical ideology that goes against your religious beliefs,” said Cliff Martin, Senior Counsel for First Liberty Institute. “We are glad to have reached an amicable resolution with Bath & Body Works.”
We’re at the stage in America where an employee in good standing will be fired, her religion disregarded, for refusing to lie. But the law is on our side.
