Bureaucrats in the Cabarrus County school system in North Carolina don’t seem to care about girls. They allow boys pretending to be girls to enter their restrooms and changing rooms, violating their privacy and undermining their safety.
America First Legal (AFL) is fighting on behalf of the girls whose pleas for privacy and safety were ignored.
The whole fiasco began after a boy was allowed to join the girls’ football and basketball cheer teams, which meant he had access to areas where girls expect privacy. The girls said they felt uncomfortable. One of them who’d testified at a school board meeting said another girl told her that he was watching girls change in the locker room.
What the administrators and the athletic director did was unconscionable. According to AFL, they did not act to correct the violation.
AFL filed a civil rights complaint to the U.S. Department of Education’s Office for Civil Rights, which agreed to investigate. AFL this week sent a demand letter to the Cabarrus County School Board, noting that when girls complain about ill treatment, bureaucrats direct them to alternative accommodations
“This causes them to forgo changing with the rest of the female members of their team and, for some, to avoid using the restroom altogether during the school day. The biological male student, by contrast, retains full use of the girls’ facilities and is asked to bear no comparable burden.”
Bureaucrats must be made to rue the day they treated girls and women this way.
AFL reminded school board members that the U.S. Supreme Court ruled that “sex” means biological sex in federal law, and maintaining single-sex facilities does not violate the law.
The demand: Within 14 days, the board must reverse the restroom and locker room access policy, provide a single-occupancy facility for the boy pretending to be a girl, and stop directing the girls to alternate facilities.
“The Supreme Court has been clear: Title IX protects the privacy and safety of women and girls, and schools that refuse to comply with the law do so at great legal peril,” said Ian Prior, senior counsel at AFL.
